ARSLAN RENT A CAR CLARIFICATION TEXT ON THE PROTECTION AND PROCESSING OF PERSONAL DATA
1- DATA CONTROLLER
Your Personal Data may be processed, within the scope explained below and in accordance with the Personal Data Protection Law No. 6698 (“Law”), by Arslan Rent A Car and by the Lessor (“Company”), whose trade name is stated at the beginning of the General Terms and Conditions of this Vehicle Rental Agreement, acting as the Data Controller.
2- PERSONAL DATA PROCESSED
Within the scope of your rental relationship with Arslan Rent A Car, including the rental agreement, the following personal data of yours is processed:
* Identity Information: Name and surname, place of birth, date of birth, age, identity card, driver’s license information and copy, Turkish Republic ID number, and passport information and copy for foreign customers.
* Contact Information: Address, e-mail address, phone number, mobile phone number, residence address.
* Financial Information: Bank account number, IBAN number, credit card information, Findeks information.
* Location information and signature, in cases where roadside assistance service is received or where it is notified that the vehicle is equipped with a vehicle tracking device.
3- PURPOSES OF PROCESSING YOUR PERSONAL DATA
If the Agreement is concluded as the Relevant Person, your Personal Data is processed in accordance with the general principles stipulated in the Law. Your Personal Data is processed by the Company in line with the commercial activities carried out by the Company, in compliance with the legislation and Company policies, for the purposes of fulfilling reporting, information retention, notification obligations and legal obligations required by official institutions; ensuring organization and event management; fulfilling the Company’s obligations arising from the relevant legislation; managing customer relations and corporate communication processes; and ensuring the commercial and legal security of real and legal persons with whom the Company has a business relationship.
Your Personal Data is processed within the limits specified in the Law, in accordance with the law and the rules of good faith, and always in a manner connected, limited and proportionate to these purposes. 4- PURPOSES OF TRANSFERRING PERSONAL DATA
Your processed Personal Data may be transferred, within the scope of the purposes stated above and in accordance with the conditions specified in Articles 8 and 9 of the Law, primarily to legally authorized public institutions, judicial and administrative authorities, private law legal entities and real persons permitted under other legislation, institutions and organizations authorized to audit the Company, contracted payment institutions for the fulfillment of payments and financial obligations, business partners from whom services are received or with whom cooperation is carried out for the execution and development of the Company’s activities, and, only when necessary, to the Company’s suppliers, provided that the data security measures specified in the Law are taken.
5- METHOD AND LEGAL BASIS FOR COLLECTING PERSONAL DATA
Your personal data may be obtained by the Company for the purposes listed above, either fully or partially through automated means or through non-automated methods, provided that they are part of a data recording system. Accordingly, your personal data may be collected physically through the execution of this agreement and printed forms, and electronically via the internet, cookies, online forms, and SMS verification codes.
The personal data processed may be processed and transferred for the purposes stated in this Clarification Text within the scope of the Personal Data Processing Conditions, based on Articles 5 and 6 of the Law and the legal grounds detailed below:
* The existence of explicit consent in cases where the Relevant Person has given explicit consent pursuant to Article 5/1 of the Law.
* Being clearly stipulated by law pursuant to Article 5/2-b of the Law, and being mandatory for the Data Controller to fulfill its legal obligation pursuant to Article 5/2-ç of the Law, including but not limited to the Law No. 6563 on the Regulation of Electronic Commerce, the Regulation on Commercial Communication and Commercial Electronic Messages and relevant legislation, the Law No. 6502 on Consumer Protection, the Turkish Commercial Code No. 6102, the Tax Procedure Law No. 213, the Turkish Code of Obligations No. 6098, the Law No. 5651 on the Regulation of Publications on the Internet and Combating Crimes Committed Through Such Publications, and the Identity Notification Law No. 1774 in the event of vehicle rental.
* Being directly related to the establishment or performance of a contract pursuant to Article 5/2-c of the Law, provided that the processing of personal data belonging to the parties of the contract is necessary.
* Being made public by the Relevant Person pursuant to Article 5/2-d of the Law.
* Being processed based on the legitimate interests of the Data Controller pursuant to Article 5/2-f of the Law.
6- RIGHTS OF DATA SUBJECTS UNDER THE LAW
As the Relevant Person, you may apply to Arslan Rent A Car at any time and request to:
* Learn whether your personal data is being processed,
* Request information if your personal data has been processed,
* Learn the purpose of processing your personal data and whether they are being used in accordance with that purpose,
* Know the third parties to whom your personal data is transferred domestically or abroad,
* Request correction of your personal data if it has been processed incompletely or incorrectly,
* Request the deletion or destruction of your personal data within the framework of the conditions stipulated in Article 7 of the Law,
* Request that the transactions carried out pursuant to subparagraphs (d) and (e) of Article 11 of the Law be notified to third parties to whom your personal data has been transferred,
* Object to the occurrence of a result against you by analyzing your processed data exclusively through automated systems,
* Request compensation for damages if you suffer damage due to the unlawful processing of your personal data.
You may request to exercise your rights. You may submit your requests regarding your rights and the implementation of the Law by filling out the application form that you can obtain from the Company and sending it with a wet signature to info@arslanrentacars.com through a notary public, by registered mail with return receipt, or through personal application. You may also submit the application form filled out electronically by signing it with your mobile signature or secure electronic signature and sending it to info@arslanrentacars using your KEP address or the e-mail address already registered in the Company’s data recording system.Arslan Rent A Car will respond to requests within this scope in writing free of charge up to ten pages. For each page exceeding ten pages, a processing fee of 10 Turkish Lira will be charged. If the response to the application is provided on a recording medium such as a CD or flash drive, the fee that may be requested by the Company shall not exceed the cost of the recording medium.
